Subj: Clean Water Down the Drain Date: 95-05-09 22:36:22 EDT From: Zen7 TO: All Activists FR: Rick Hind, Legislative Director-Greenpeace Melanie Silvercloud, Toxics Info Intern-Greenpeace RE: Clean Water Down the Drain On this Wednesday, May 10th, Congress has scheduled the Clean Water Act for dismantling on the floor of the House of Representatives. This battle is expected to last for several days, possibly into the following week. The entire environmental community is unanimous in opposing this bill. As you may have read in the NY Times, this bill was written by and for the polluters. It will severely weaken the current law in many ways. It will allow more toxics in our water, gut wetlands protection, cripple the Great Lakes Initiative, require risk assessments and much, much more. Reliable sources say that although the Congress is intoxicated on the partial success of their "Contract", an environmental backlash may be brewing. Some members of Congress have privately expressed concern to Gingrich that such a naked attack on the Clean Water Act could backfire politically. Obviously, groups are encouraging EVERYONE to call their Representative at (202)224-3121 to vote AGAINST the (Bud) Shuster Dirty Water Bill (H.R. 961). To find out who your Representative is, call the following # for your time zone and press 5: Eastern (800-347-1997), Central (800-366-2998), Mountain (800-359-3997), Pacific (800-726-4995). (Please forward copies of your email to the same box so that we can track our effectiveness!) Another way to slow down the House and send that same message would be to call Newt Gingrich's nerve center, his press office, at (202)225-2800. Quebec Hydro electric has apologized for a report sent out in 1991 about stating the Natives ( Cree ) were a threat to security of Quebec's Hydro stations. They stated that at no time did the tell or give permission for Hydro Police to spy on the Cree or environment groups that support the Cree. The Cree and others presented a complaint in 1993 when it was learn that a report that the police were given new directions to follow. Hydro Quebec's report requested that the force gather information. They wanted them to look into things like radical social groups and were moving to terrorism. The Cree have pull complaint but still feel that Hydro can not be trusted and no one can blame them. The 188 police state that their job is to protect the sites and have nothing to do with spying on anyone, or any groups. Grand Chief Namagoose was upset the a public inquiry was not done to look into the what this police force was doing or had been doing up till now. Hydro spoke persons claim they have never spied nor do they intend to and that the police were only to protect the sites and from anyone stealing electricity. Anyway have you ever known anyone that has a police force admit to spying on someone ? Anyway in the end Hydro gives it word it will spy on the Cree or anyone else. Gee, this is so hard to not believe, when we think of things like wire taps, cellular phones, scanners that might just be for enjoyment. The letter to Chancellor Kohl is attached. Identical letters were sent to the Defence Ministers of the Netherlands and Great Britain. The Innu Nation is appealing to the European governments to respect Innu rights and environmental rights, rights which were completely disregarded by the government of Canada in its May 1st decision to approve an increase in the number of military training sorties from 7,000 to 18,000, including 15,000 low-level sorties, over an expanded area of 130,000 square kilometres with additional bombing ranges. The Innu Nation is appealing to people and organizations of goodwill everywhere to both denounce the decision of the government of Canada and to join with the Innu Nation in asking that the European governments refuse to renew the Multinational Memorandum of Understanding ("MMOU") to conduct low-level flying over Nitassinan until the government of Canada agrees to certain minimal standards of human rights and environmental protection as proposed by the Innu. The 130,000 square kilometres approved for the flying is the homeland of 13,000 Innu people. It is not a wasteland. The area is in the heartland of the Innu traditional land upon which we are dependent for our survival. The low-level flying severely threatens the environment and consequently our culture. RECKLESS DECISION BY CANADIAN CABINET We find it incredible and reckless that Environment Minister and Deputy Prime Minister Sheila Copps and Indian Affairs Minister Ron Irwin would endorse the Cabinet decision which so completely disregards the rights and future of the Innu people and the environment. This is particularly distressing since there is no international security justification for the continuation let alone the dramatic increase in the number of low-level training flights. The decision was made solely for the economic benefit of the Canadian government and the 8,600 people of the largely non-Aboriginal community of Happy Valley-Goose Bay. The decision is in callous disregard for the human rights of the Innu people who will suffer all of the impacts of the flying while the benefits go to non-Aboriginal people. In its decision of May 1st, the government virtually rubber stamped the February 1995 recommendations of the federal Environmental Assessment Panel. The Panel found scientific uncertainties about the environmental and health effects of the project, uncertainties about the Department of National Defence's (DND's) avoidance program and social tension and polarization around the proposal. It added that with these problems, a first reaction might be that the project should not proceed. Nevertheless, the Panel recommended an increase in the number of flights because of the economic benefits to Happy Valley-Goose Bay. The Panel's recommendations and the decision of Cabinet are a transparent and immoral choice for short term economic benefits over human rights and environmental protection. This decision should be of great concern to everyone who believes economic growth should be leavened with appropriate attention to human rights and the environment. THE PROPOSED MONITORING INSTITUTE The Cabinet attempted to justify its decision by announcing the establishment of an Institute to monitor and propose mitigation of the ongoing impacts of the low-level flying on the environment. The Innu support an institute with appropriate terms of reference and composition. However, we disagree fundamentally with the "adaptive management" philosophy proposed for the institute. Adaptive management operates on the basis of admitting that we do not know what the impacts of low-level flying are, but permits the activity to proceed (and in this case increase dramatically) while we set up an institute to monitor the impacts. This is a very perilous approach. It is the same business-as-usual approach under a new name that led to the destruction of the east coast cod fishery, the near destruction of the Great Lakes and countless other environmental problems. The Innu believe that their rights and the environment should receive due attention and that the low-level flying should not be continued or increased until the DND can meet the onus of demonstrating that the activity can be undertaken without serious violation of the rights of people or the environment. The Innu are not guinea pigs! In the case of low-level flying, the DND did not come close to meeting this onus despite having spent over $10 million over a ten year period. The Panel recommended that the institute be set up for the very reason that it found that the DND had not met the onus either in terms of compiling adequate baseline environmental data, adequate research on the impacts of the low-level flying on the environment, or with respect to its avoidance strategy. On March 28th, the Innu Nation informed Environment Minister Copps, Minister of National Defence Collenette and Indian Affairs Minister Irwin that the Innu were prepared to discuss their participation in the institute based on the same five conditions we are now urging the European governments to attach to the MMOU. At that time, the Innu Nation also requested that its technical people meet with the technical people of the three Ministries to further outline their problems and concerns with the recommendations of the Panel and the possible participation of the Innu in the institute. The Innu heard nothing in response to either request until the public announcement of the Cabinet's decision on May 1st. So despite critical public comments to the contrary, Canada in fact refused to discuss this matter with the Innu. PROPOSED INSTITUTE LACKS CREDIBILITY In endorsing the Panel's recommendation for the institute, Canada made these comments which deepen our concern about the credibility of the proposed Institute. + The Institute for Environmental Monitoring and Research will be an advisory body reporting to the Ministers of the Environment and National Defence (emphasis added) + The activities of the Institute "are intended to support the viability of the proposed low-level flight training (emphasis added) + The Institute will support research and studies "which support the low-level flying project (emphasis added) + The Institute will among other tasks "have a mandate to engage in public education and information dissemination on the impacts and effects of low-level flying. The Innu are profoundly disillusioned about the refusal of Canada to work with us in setting up a responsible institute that is more than an advisory committee to the DND which has such a long and consistent record of completely ignoring Innu concerns. EFFORTS DIRECTED TO INTERNATIONAL ARENA Over the next year, the Innu will concentrate on persuading European governments and people to attach responsible conditions to their willingness to renew their agreements to conduct low-level flying. These efforts will be directed at the governments of the Netherlands, Germany and Great Britain who are presently conducting low-level flying and the governments of France, Italy and Belgium who are discussing the matter with Canada. The conditions are set out in the attached letters to those governments. The Innu appeal is that these governments refuse to sign agreements until Canada meets the five reasonable conditions. HUMAN RIGHTS The Innu appeal to these countries is based on international respect for human rights. The Innu hope to persuade these governments that it would be immoral and in violation of the international human rights of the Innu and devastating for the environment if they were to accept Canada's invitation to continue low-level flying without Canada agreeing to the five conditions. We believe that European governments should not continue low-level flying just because Canada is issuing an invitation. Neither should European governments rely on the environmental assessment or the rubber stamping of that report by the Canadian Cabinet. Respect for human rights means that European governments have their own responsibility to determine it is responsible to conduct the low-level military training in Nitassinan. If they rely simply on Canada's permission to conduct the low-level flying, European governments are in violation of the international covenants they have signed because it is the direct action of those governments in conducting the low-level flying that negatively impacts on the Innu people, violating their human rights and destroying their environment. MORAL DUTY ON COUNTRIES NOT TO EXPORT HARM The responsibility of the European governments not to export harmful substances or activities is obvious from the following examples. When a responsible government considers whether or not to export toxic wastes, it goes beyond inquiring whether another country will accept the toxic waste. Since the toxic waste could harm the people of the proposed host country, the exporting country has the duty to ensure that the proposed host country meets international standards for the disposal of toxic wastes. Another example is the proposed export of pharmaceutical products. A responsible government will not permit the export of drugs which are deemed unsafe for its domestic market to another country where drug standards are below internationally accepted standards. To do so would endanger the health of the people in the host country and constitute a violation of the international human rights covenants which the exporting country has signed. A third example is the issue of Apartheid in South Africa. Most European governments did not say to the Blacks in South Africa "The South African government has a policy of Apartheid, so we will respect that policy". Instead, the governments made their own judgments of whether Apartheid was in keeping with international human rights standards and imposed sanctions against the South African government. These sanctions were instrumental in the abolition of Apartheid. It is our position that the European governments owe the same duty of care and responsibility with respect to the low-level flying that it is exporting to Nitassinan. If the European governments did their own investigation, they would discover that the Treaty which they entered in 1986 with Canada to conduct the low-level flying is with the wrong country. In the Treaty, Canada purports to give the European governments permission to conduct low-level flying over Nitassinan for a period of ten years, running from 1986 to 1996 with the details to be set out in a Memorandum of Understanding. When the European governments signed the Treaty, they were under notice from the Innu Nation that Canada had no right to sign the Treaty because the Innu Nation had never entered into a Treaty with Canada giving Canada permission to licence activities in Nitassinan. Since they are under notice, the European governments have a responsibility to conduct their own investigation of Canada's treaty making capacity. It is a contravention of human rights standards for the European governments to simply accept the word of the Canadian government regarding this matter. CONSTITUTIONAL RIGHTS The Innu Nation have what is legally described as "unextinguished aboriginal title" protected in s. 35(1) of Canada's Constitution Act (1982). The Innu have such rights because they have never entered into a Treaty with Canada to set out their respective rights and responsibilities in Nitassinan. Canada has recognized its responsibility to negotiate a Treaty with the Innu Nation and negotiations have been underway for some years, although they have been unilaterally suspended by governments for two long stretches of time over the past three years. Canada's Constitution provides that the Treaty will have Constitutional protection. Canada has no right to enter a Treaty with the European Nations before it has entered a Treaty with the Innu Nation. This is the conclusion that the European governments would reach if they conducted their own investigation based on the requirements of international human rights. In conducting the low-level flying, without appropriate conditions, the European governments are not only in violation of international rights, they are also interfering with the possibility that Canada, Newfoundland and Innu can reach agreement on the terms of their Treaty. They are accordingly prejudicing the rights of the Innu people. The situation is comparable to a civil dispute between two neighbours over a piece of property. Until the dispute is settled, neither of the parties has the right to dispose of the property in dispute or to give a third party any rights regarding the disputed property. If either party attempts to do so it also makes agreement between the parties much more difficult to achieve. A third party on notice of the dispute has the duty not to enter an agreement respecting the property with either of the parties. The European governments have a positive duty to inform Canada that until Canada has settled its relationship with the Innu or the Innu have approved of the Treaty, the Europeans will not enter a Treaty with Canada because such a Treaty would violate the international rights of the Innu people and the Innu Nation. European governments often say they cannot interfere with the internal affairs of Canada. But in entering the Treaty with Canada they are interfering with the internal affairs of the Innu Nation and are interfering with the Treaty negotiations between Canada and the Innu Nation. The fact that Canada welcomes this interference does not change the situation as the Innu Nation opposes the interference and the European governments must make their decision based on the concepts of international law and human rights. CANADA'S POLICY TO ASSIMILATE THE INNU Canada's offer to European Nations to use land and airspace that is the subject of negotiations between it and the Innu Nation is consistent with Canada's policy of attempting to assimilate First Nations people and to drive them from their traditional lands. In our view, the end result of this assimilation policy will be the social if not the physical extermination of the Innu people in violation of the international covenants which recognize the right of Indigenous Nations and peoples to self-determination. By conducting low-level flying in Nitassinan the European governments are participating in this process of assimilation and cultural genocide of the Innu people. The onus on the European governments not to continue to fly unless Canada meets the five conditions is particularly high because two hundred years of assimilation pressures have taken a heavy toll on the Innu people. The social and physical conditions of the Innu are well below international standards and the imposition of low-level flying could be "the straw that breaks the camel's back". The right and honourable thing for the European governments would be for them to inform Canada that they will discontinue the low-level flying until Canada has resolved its dispute with the Innu people or met the five conditions. ONUS ON DND TO DEMONSTRATE SAFETY OF LOW-LEVEL FLYING With respect to the environment, it is not acceptable for the European governments to simply accept the finding of the environmental assessment process in Canada and Cabinet's rubber stamping of those recommendations. The Innu critique of the Panel's report is available upon request from the Innu Nation. It is not acceptable to conduct the flying without knowing the impacts or without Canada agreeing to reasonable conditions. If the European governments consider that low-level flying is acceptable they should conduct the low-level flying over their home countries rather than exporting it to Nitassinan where the traditional way of life of the Innu people is dependent on the land and its resources. If it is unacceptable for low-level flying to be conducted over their home countries it is equally as unacceptable for the European governments to export the low-level flying to other people in another country. Responsible nations must adopt responsible policies. It is no longer acceptable to require that individual or collective victims demonstrate damage before a proponent is required to stop questionable activity. The onus has long been on the victim and the earth is now in peril. Reversing the onus is not a difficult political decision when there is absolutely no good military reason why the low-level military flying should continue. A week ago two young Mohawk men died tragically in a boating accident on Lake of Two Mountains. In order to bury these men in the sacred burial grounds of the community, the band council ordered a couple of trees cut to expand the over-crowded cemetery. The town of Oka claims that this land belongs to them and the Mohawks have no right to bury the men there or to cut trees. This is the same property, the Pines, that sparked the dispute over expansion of the golf course in 1990. The funeral of the two men is scheduled to begin at 2 pm this afternoon. Newspaper and other media personnel are being excluded from the area as Mohawks are not allowing them up on the hill in the area of the Pines. A Mohawk spokesperson said that the ceremony is very sacred and is not open to any outsiders. The Provincial police say that as it is a public road, the Mohawk do not have the right to block the road but say they have no plans at the moment for any sort of action. Unfortunately, the death of these two Haudenosaunee has become the excuse to flare tensions in the area once more.... an area where tensions are running fairly high with the planned vote in June on a native run casino promoted by the Band Council. The funeral did take place without incident. --------- "RE: Poem: Thunder and Snakes:Full Moon Dancing" --------- Date: 23 Jul 1994 18:09:03 -0500 From: turtle@aicap.s21.com (Turtle Heart) Subj: Thunder and Snakes:Full Moon Dancing Newsgroup: alt.native ssssssssssssssssssssssssss.......... as the Thunder walks across the wide sky Snake moves the same way upon the belly of the earth moon-light falls like a sacred arrow pounding softly upon the hearts of dancers dancing in the night wind holding their own thunder breathing their own breathing pushing their dreams into the silent dust dancing by holding holding feathers through the long night Tobacco Indian -- Turtle Heart turtle@soft21.s21.com (Ahnishinabeg) American Indian Computer Art Project BBS 619-374-2100 Land of Kaw-ii-su ancestor: Land of Light --------- "RE: Verse: Hawai'ian Book of Days" --------- Date: 95/05/19 00:15 From: Debra F. Again I hear the Sacred Mother speak, through the women prisoners. "Where are my Children?" Passing the last 3 years, taking the prayers for the men's prayer circle at OSP to the sacred Sundance ceremony, the female side of our being had not yet touched my heart. At special request I started to approach the county jails at which time Native women started to attend a talking circle. It was at this time that I heard our Sacred Mother speak to me through the tears of the women prisoners. "Where are my Children?" Unlike those who say "They should think of the things they did to put their children or themselves in this position," I do not blame the Sacred Mother for her Children being taken away from her by the reservation / relocation actions, but try to let the Sacred Mother know that we are alive today and making our connection to her stronger through prayer, unity, and the ceremonies. Pray for the Sacred Mother. Pray for the prisoners. The Children have been removed from Her by trying to SUCCEED by the standards, means, and values given to us by the dominant culture, and that we have had to live these lies i.e. success is acquiring things, "The more you have the greater you are." With our people, "The more you give, the greater person you are." The chemical quick fix in lieu of accepting suffering as part of life, takes us to the chemical dependency prisons of Native America. The Mother cries, "Am I to blame?" At OSP (the men's state prison) we let our sweat down through the sacred sweat ceremony every week ... some Children, the Mother still wonders "Where are my Children?" Pray for the Sacred Mother. Pray for the prisoners. We are caribou people. We are among the most traditional Native peoples today. We rely on the caribou coming every year for our subsistence and way of life. It has been this way for a thousand generations. Now they want oil development in the exact place the caribou use every year to give birth and nurse their young. We need your help THIS WEEK to protect the caribou and and give our communities a future. We face a two-step attack. First, by the end of this week the US Senate and House of Representatives will vote on the "Budget Resolution" that includes more than a $1 billion in income over five years from selling oil leases in the Arctic Refuge. The second step is actual authorization of leasing. Because of how the budget rules work, the Budget Resolution sets revenue targets for the different committees. This will put tremendous additional pressure on Congressional committees to authorize Arctic Refuge oil development, since few alternative sources can generate that much revenue. (The $1billion figure is wildly inflated, but once accepted, it sets the revenue target alternatives must meet.) We expect authorizing legislation will be considered in June or July. Please contact your Senator today! If you can do more, contact your representative too. The capitol switchboard telephone number is 202-224-3121. Please ask your Senator or Representatives to: 1. Oppose oil leasing revenues from the Arctic National Wildlife Refuge in the Budget Resolution; and 2. Please co-sponsor the wilderness bill (S428 for Senators, and HR1000 in the House of Representatives.) Wilderness protection is the best way to protect the caribou birthplace, which is sacred to us. Please tell them in your own words why they should not sacrifice the caribou and priceless wilderness for less than 200 days of oil. This is a very serious threat to develop the Arctic National Wildlife Refuge. Our normal avenues of defense are not as available to us in this case--the budget process cannot be "filibustered" in the Senate and is very unlikely to be vetoed by the President because of all the thousands of provisions it will contain besides this one opening the Refuge. Your Representatives and Senator need to hear from you now. Please distribute this Action Alert to as many people as possible. If you have access to other computer bulletin boards, please cross post this alert. Mohawk Peacekeeper took his car back to the Kahnawake and later learned it was a undercover cruiser. The Quebec Police then called the Peacekeepers and requested the return of the $100 they had collected for towing the car but the Peacekeepers refused. With that Cpl Claude Cheff the office in charge of dealing with Mohawk Peace Keeper threaten to cut off access to their computers in tracing license plates. With that the Peacekeeper reported this to Band Council. The Council then contacted Minister Serge Menard, who is the Public Security Minister for the province of Quebec. Right now the Quebec police are investigating the conduct of its officers. You see, going back to 1979 when the Quebec Police shot and killed my brother-in-law the Council passed a law that states "That officers will only we allowed in by invitation." Follow this with the 1990 Oka Crisis and we have what could be called a very tense situation. Anyway, it comes down to did the officer break the law and because Mohawk Peacekeeper caught him he can go free ? Standley St., Ukiah, CA 95482 PROTEST "AMERICA'S MOST WANTED" BIASED RE-ENACTMENT OF COVELO TRAGEDY The "America's Most Wanted" Fox TV show plans a Saturday, May 27 broadcast of a one-sided and potentially inflammatory "re-enactment" of the Round Valley Indian Reservation slayings of April 14, which left two Native American men and a deputy sheriff dead. The continuing intensive manhunt for the alleged cop-killer has resulted in a state of siege by law enforcement against the Round Valley Native American community, and nearby Native American rancherias in Mendocino County, California. The Covelo Indian Community is a sovereign nation of six tribes: Yuki, Wailacki, Pomo, Concow, Numlacki and Pit River. The Round Valley Community Support Coalition yesterday received a copy of a letter from the Leonard Peltier Foundation of Groningen, Netherlands, to America's Most Wanted, expressing concern for the prejudicial effect the show's coverage may have on the audience and the residents of Round Valley. The letter included the statement: "Looking at the events following the shootings, Pine Ridge Reservation in South Dakota comes to mind, where the U.S. Government in the mid-seventies not only harassed the local residents in a similar way, they also manipulated the media, and turned a relatively fair and impartial judicial system into a tool of political repression against Native Americans." For more details about the case, see the Round Valley Slayings article by Nicholas Wilson, dated 5/16/95, and Update Round Valley, dated 5/19/95, posted to Native-L and alt.native and Planet Peace web site. The filmed re-enactment is based entirely on the sheriff's version of the slaying of Leonard "Acorn" Peters by deputy sheriffs and the shooting of one of the deputies by an unseen assailant. The show's producers did not contact the families of Leonard Peters or the suspect, Bear Lincoln, for their version of events. Many people believe the sheriff's version is a cover-up of fatal mistakes by his own deputies, including shooting an unarmed innocent man and the possibility of the slain deputy being killed by "friendly fire" from his partner's M-16. People can contact the TV show's producers and sponsors to express their concern and ask that the one-sided episode not be aired. It is a native Hawaiian belief that from this planting comes *ulu* (growth), both physical and spiritual. The bones of our ancestors nourished the ground from which our food grows, which, in turn, nourishes our bodies. Secure in the knowledge that our ancestors are where they belong, in Hawaiian earth, free from harm, our spirits are nourished as well. When speaking of one's ancestors, it is appropriate to recite one's *mo'ok u 'auhau* (genealogy). By reciting the names of my ancestors, I am reminded that but for their existence, I simply would not be. I am humbled by this reminder and duty bound to care for those who came before me. In 1988, on Maui at a place called Honokahua, a private landowner obtained permits to develop a Ritz Carlton hotel. During construction, more than 1,100 ancestral native Hawaiians were archeologically removed and examined, over many protests. Hui Malama I Na Kupuna 'O Hawai'i Nei, which means "group caring for the ancestors of Hawai'i," was born from the anguish of Honokahua. The group, founded by Edward and Pualani Kanahele, was established to return the bones of the native Hawaiians to their families, to replant them, and to protect sacred burial and reburial sites. Eventually, native Hawaiians pressured the state to purchase the land at Honokahua and appropriate funds for reburial. The ancestors were ceremonially replanted and the reburial site sealed. One lesson learned from Honokahua was that, even though it was our sacred responsibility as descendants of these ancestors, we did not have the legal authority to determine the proper treatment of their burial sites. Nor were many of us trained in the protocols related to the handling of ancestral burial objects. Much had to change. In July 1990, state legislation was enacted creating island burial councils, made up of a majority of native Hawaiians, to decide whether to preserve or relocate burial sites on state and private lands. I administer the councils as director of the burials program, which is part of the state historic preservation division in the department of land and natural resources. On the federal level, the National Museum of the American Indian Act specifically authorized Hui Malama to conduct repatriation of remains and burial objects from the Smithsonian. In July 1990, the group coordinated the first of three repatriations from the Institution's National Museum of Natural History. These efforts, culminating three years later, resulted in the return of approximately 229 ancestral native Hawaiians and burial objects. Funds for the first repatriation came from our own pockets-- so strong was the inspiration, the calling, by the ancestors to be brought home. What Hui Malama began to understand from this first repatriation experience is that we are merely vehicles to conduct the work and that it is really the ancestors who are directing us, guiding us to them and returning them home. To listen to the calling, the group maintained *pule* (prayer) requesting assistance and inspiration from God and the ancestors. We ask, +e homai ka 'ike* grant us knowledge, +e homai ka ikaika* grant us strength, +e homai ka akamai* grant us intelligence, +e homai ka maopopo pono* grant us righteous understanding, +e homai ka 'ike pa pa lua* grant us visions and avenues of communications with the other side, +e homai ka mana* grant us positive energy. In November 1990, the Native American Graves Protection and Repatriation Act provided the legal means to return ancestral remains and burial objects to Hawaii. The new law represented an attempt to make things *pono* (correct; right) for these ancestors. By learning the language of NAGPRA, and more importantly, by spiritually reconnecting with na kupuna, we have been inspired to repatriate and rebury ancestral Native Hawaiians held at federally funded institutions ranging from the American Museum of Natural History in New York City to the Field Museum in Chicago. Internationally, Hui Malama has returned ancestral Hawaiians from as far away as the University of Zurich Institute of Anthropology. Hui Malama firmly believes that the repatriations and reburials were a direct result of intervention by God and the ancestors to inspire and energize us. For us, *pule* is reality, for through *pule* spiritual help is requested to affect the physical world. And so the relationship between ancestors and descendants is one of interdependence--the living have a duty to care for the dead. In turn, the ancestors respond by protecting us on the spiritual side. One cannot completely exist without the other. At the same time, the members of Hui Malama have been subject to the pain suffered by the ancestors as a result of the taking. By acquiring knowledge of past mistreatment, we relived anguish and frustration. This motivated us to accept the responsibility of caring for the ancestors and ultimately seeking what is right. In Hawaiian thought, sense of place is a very strong value-- that which is above remains above, that which is below remains below. The proper place for ancestral Hawaiians is not on a museum shelf or display, but rather planted in Hawai'i. Absent consent from families, ancestral remains should never have been removed. Such actions have disturbed the balance of things. For the most part, our experiences with repatriation have been positive. We offer museums two paths. The first is one of peace. We say treat us as partners, as natives, as human beings, and follow the NAGPRA law. We hold much aloha for those institutions who have, and share our hospitality with staff whenever they visit Hawai'i. The second path is confrontation. We prefers [sic] the former; however, it does not matter which path is elected. In sharing aloha or going to war, we maintain a balanced perspective. Our experience with the Hearst Museum followed the second path. In September 1992, the museum repatriated two incomplete sets of ancestral Hawaiian remains to Hui Malama, refusing at the same time to release two additional sets. We asked the NAGPRA review committee to help resolve the dispute. At issue was testimony by members of Hui Malama regarding a ceremony conducted at the museum. The members said they were clearly inspired by the spirits of the ancestors to take them *all* home. Hui Malama asserted that to rely solely on physical evidence would discriminate against us as a spiritual society. The committee decided to hold hearings in Hawai'i on the matter. For the first set of remains, Hui Malama established their cultural affiliation with ethnographic, archeological, and osteological data--in addition to spiritual evidence. However, with regard to the second set of remains, the skull of "a Polynesian," the committee was unable to make a finding of affiliation. Nonetheless, the committee recognized that the remains were clearly from Hawai'i and recommended they be returned to a museum there to help clarify the issue. The museum accepted both recommendations. In August 1993, Hui Malama returned to the Berkeley campus of the University of California, where the museum is located, to conduct repatriation. Upon return to Hawai'i, the second set of remains were turned over to the Bishop Museum, which conducted physical examination and confirmed that the remains were indeed that of a *kanaka maoli* (native Hawaiian). Soon thereafter, both sets of remains were replanted. Our efforts, then and now, are guided in part by a belief that the ancestors may exact retribution for failure to protect them from those who would steal their *mana*. We advocate against scientific study. In our view, such actions amount to desecration--handling bones without prayer, without protocol, and with the intent to take without permission. We wonder how an act that desecrates the dead could possibly benefit the living. Moreover, we wonder what benefits accrue to the ancestors. For those who advocate osteological examination of native Hawaiian remains, I say the following. Osteology begins at home. Study the bones of your ancestors first, before touching ours. In my grandmother's last days, she never told me that my lessons in Hawaiian culture would continue beyond her death by digging up her bones and subjecting them to examination. This is not a Hawaiian custom. Instead, without saying, my grandmother's teachings continue through my prayers and dreams. The point is that science is not the only means to define man's existence. Spirituality is the necessary balance. Hui Malama members have been taught by our *kumu* (teachers) that: +Nana ma kou e ma lama i na iwi o ko ma kou kupuna Nana mo'o e ma lama i kou ma kou iwi A ho'omau ka lokahi o ka kou* We will care for the bones of our ancestors Our children will care for our bones As we continue this interdependency. Hopefully, if we teach our children right, barbaric acts of grave robbing will not happen again and our own bones can be planted, grow, then disintegrate and return to *Papahanaumoku* (*Papa* the earth mother). I close with the words of the Kohala chief Kamehameha, who united the Hawaiian islands under one rule: +Imua e na poki'i a inu ka wai 'awa'awa 'A'ohe hope i ho'i mai ai* Forward my children and drink the bitter waters There is no turning back Mahalo. ------------ For more information, Edward Halealoha Ayau can be contacted at Hui Malama, Post Office Box 190, Hale'iwa, Hawai'i 96712-0190, (808) 587-0010, fax (808) 677-8230.
